Compassionate Child Custody Lawyer
When parents divorce, the divorce decree will specify with whom the divorcing couple’s children will live (and circumstances under which the other parent will visit the children). Often, parents work out these arrangements between themselves, either completely voluntarily or with the assistance of their attorneys or a mediator. When they are unable to reach a decision, however, the court may intervene and make a decision based on the child’s best interests.
At the Law Firm of Grant E. Bayerle, APC, you can have a devoted family law attorney at your side to help you secure the best possible outcome in your custody case. Grant E. Bayerle and his staff collectively have decades of experience and dedication to family law matters. We know that you want what is best for your children, and we are committed to helping you achieve that goal.
Physical And Legal Custody
In most situations, physical custody is awarded to one parent with whom the child will live most of the time. Often, however, the custodial parent shares “legal custody,” which includes the right to make decisions about the child’s education, religion, health care, and other important concerns.
Physical custody falls into several categories. Sole custody is when one parent has 100% of the visitation rights. When custody becomes split between both parents, there can be a few differences:
- Joint custody allows the child to spend an approximately equal amount of time with both parents. Proponents of this arrangement say it lessens the feeling of loss that a child may experience in a divorce.
- Split custody gives one parent custody of one or more of the parties’ children and the other parent custody of the other(s). Courts usually prefer not to separate siblings; however, when issuing custody orders.
If you do not have or earn the majority of full custody, you will likely deserve the right to have regular visitation with your children. We can help review your situation, determine what you are eligible for, and fight to earn that right. Even the most extreme cases still see both parents in contact with their children, and you deserve the same right.
